,i <br />Section I -History <br /> <br />On February 16, 1993, MINREC, Inc. submitted an application to renew the valid, existing permit <br />for reclamation at the North Thompson Creek Mines. The application was approved on August <br />12, 1993. The five year permit term was renewed effective August 15, 1993, and will expire on <br />August 15, 1998. <br />Two bond release applications have been received by the Division since the permit renewal. The <br />first application was for a Phase II bond release and was received by the Division on September <br />13, 1993. The Division issued a proposed decision on November 23, 1993. The Phase II bond <br />release was denied at the mine site on the basis that additional vegetation was required to meet <br />the species diversity standard. However, within the context of the same bond release application, <br />a full bond release was approved for an area of disturbed prime farmland located at the unit train <br />loadout. <br />The second bond release application was received by the Division on October 22, 1993. The <br />application was for a full bond release for the portion of the unit train loadout known as the <br />"Diamond A Pazcel." A full release was requested, because the Diamond A Parcel had been <br />developed as a housing community and, therefore, would not be reclaimed. The full bond release <br />for the Diamond A Parcel was approved on November 24, 1993. <br />One enforcement action was taken since the pernut was renewed. The action taken was a notice <br />of violation (NOV). A description of the NOV and its status follows: <br />Notice of Violation C-94-030: <br />Issued October 17, 1994 <br />The nature of the violation was: <br />"Failure to reclaim ponds and impoundments and provide appropriate spillways and <br />conduct quarterly inspections." <br />The notice was issued in response to aten-day-notice from the Office of Surface Mining. The <br />notice was abated when the operator reclaimed the ponds in question and submitted a technical <br />revision to the permit which included designs for the reclaimed areas. The notice was terminated <br />on May 1, 1995. <br />The operator was fined $250.00. <br />3 <br />
