dated February 5, 2001, that summazized the status of, and requested additional information for, <br />the second adequacy letter. <br />The operator sent responses to the Division's first adequacy letter in a letter dated February 5, <br />2001. Ownership and Identification of Interests information was updated. <br />The Division suggested adding three fortis to the reclamation seed mix for USDA-FS land <br />disturbance. However, the USDA-FS declined to include the three species into their seed mix. <br />The Division accepted their response, with the caution that the approved reclamation standards <br />will still apply to any disturbed range land. <br />Several days before the proposed decision was determined, the AVS, again, recommended a <br />conditional approval. Therefore, Stipulation No. 8 was attached to the proposed decision for <br />Permit Revision No. 4. <br />Additional permit information was presented by BRL, in submittals dated February 19, 2001, <br />and February 23, 2001, as responses to concerns by government agencies. <br />Eventually, all governmental agencies that had raised adequacy questions concerning Permit <br />Revision No. 4 replied to the Division that all issues had been dealt with satisfactorily. <br />The details of the adequacy concerns and all of the correspondence letters aze available in the <br />Denver office of [he Division. <br />Description of the Environment <br />The Bowie No. 2 coal mine permit area includes 2850 surface acres, of which 507 surface acres <br />are federally owned. Most of the coal and the surface lands within the present permit area are <br />privately owned, as are all surface areas that have been disturbed by surface developments. A <br />portion of the coal and surface lands is federal. The total azea disturbed by surface operations <br />presently is approximately 92 acres. Inclusion of the Iron Point Tract Federal Lease into the <br />Bowie No. 2 permit area through Permit Revision No. 4 would increase the federal coal and <br />surface lands within the permit area, but would not increase the disturbed acreage at this time. <br />In the original permit application review, following discussions with the OSM in Denver and <br />based upon the specific recommendations of the OSM, it had been determined that the Bowie <br />No. 2 Mine would be considered a private mine for the purposes of permitting and inspection <br />regulation. However, the Bowie No. 2 Mine became a federal mine upon approval of Technical <br />Revision No. 16. Through that revision, BRL was granted permission to conduct mining in a <br />limited area of the Iron Point Tract Federal Lease. <br />The Bowie No. 2 Mine is located in Delta County, approximately five (5) miles northeast of <br />Paonia, Colorado. The mine permit area is located on lands depicted on the U. S. Geological <br />Survey 7.5 minute Bowie Quadrangle Map, and the Bowie No. 2 mine portals are to be located <br />northwest of the Old King Mine portals (also known as the Bowie Mine).
