dated February 5, 2001, that summazized the status of, and requested additional information for, the second adequacy letter. The operator sent responses to the Division's first adequacy letter in a letter dated February 5, 2001. Ownership and Identification of Interests information was updated. The Division suggested adding three fortis to the reclamation seed mix for USDA-FS land disturbance. However, the USDA-FS declined to include the three species into their seed mix. The Division accepted their response, with the caution that the approved reclamation standards will still apply to any disturbed range land. Several days before the proposed decision was determined, the AVS, again, recommended a conditional approval. Therefore, Stipulation No. 8 was attached to the proposed decision for Permit Revision No. 4. Additional permit information was presented by BRL, in submittals dated February 19, 2001, and February 23, 2001, as responses to concerns by government agencies. Eventually, all governmental agencies that had raised adequacy questions concerning Permit Revision No. 4 replied to the Division that all issues had been dealt with satisfactorily. Description of the Environment The Bowie No. 2 coal mine permit area includes 2850 surface acres, of which 507 surface acres are federally owned. Most of the coal and the surface lands within the present permit area are privately owned, as are all surface areas that have been disturbed by surface developments. A portion of the coal and surface lands is federal. The total azea disturbed by surface operations presently is approximately 92 acres. Inclusion of the Iron Point Tract Federal Lease into the Bowie No. 2 permit area through Permit Revision No. 4 would increase the federal coal and surface lands within the permit area, but would not increase the disturbed acreage at this time. In the original permit application review, following discussions with the OSM in Denver and based upon the specific recommendations of the OSM, it had been determined that the Bowie No. 2 Mine would be considered a private mine for the purposes of permitting and inspection regulation. However, the Bowie No. 2 Mine became a federal mine upon approval of Technical Revision No. 16. Through that revision, BRL was granted permission to conduct mining in a limited area of the Iron Point Tract Federal Lease. The Bowie No. 2 Mine is located in Delta County, approximately five (5) miles northeast of Paonia, Colorado. The mine permit area is located on lands depicted on the U. S. Geological Survey 7.5 minute Bowie Quadrangle Map, and the Bowie No. 2 mine portals are to be located northwest of the Old King Mine portals (also known as the Bowie Mine). The surface facilities 10
