PCPC ~ • <br />Re: SUP No. 96-07 <br />3-18-96 <br />Page 4 <br />(2) The granting of the special use appeal will not substantially <br />modify the Land Use Plan or the intent, purpose, and spirit of <br />the Zoning Resolution. <br />Staff: The purpose of the A-1 Zone District is to "...retain and <br />promote the appropriate use of dry range and irrigated lands and <br />encourage open use of the land in keeping with its natural <br />chazacteristics and agricultural functions." A temporary hot mix <br />asphalt plant will occupy a small portion of the property near the <br />existing batch plant area and will not impact the intent, spirit, or <br />purpose of the Zoning Resolution. <br />(3) This special use proposal incorporates reasonable means to <br />create an environment harmonious with that of the surrounding <br />properties. <br />Staff: The surrounding properties aze currently vacant rangeland, <br />agricultural land, other mineral extraction activities and several <br />residences within a mile of the site. The proposed use is buffered by <br />distance, tree lines and hedge rows and would not create a negative <br />impact on the surrounding pazcels. <br />(4) The special use permit will not adversely affect the public health, <br />safety, and welfare. <br />Staff: The proposed use would not create a negative impact on the <br />public health, safety, and welfare. <br />RECOMMENDATIONS <br />Staff recommends APPROVAL of Special Use Permit No. 96-07 with the following conditions: <br />1. The applicant shall provide the Department of Planning and Development with a copy of any <br />and all local, state, and federal applications, permits, or amendments pertaining to SUP 96-07 <br />within 30 days of their submittal or approval. This includes, but is not limited to, MLRB, <br />404/401, water well, air quality, and CPDES permits. <br />2. The applicant shall abide by all permits and plans submitted to federal, state, and local <br />agencies. Any violation of a permit or plan shall result in the scheduling of a Show/Cause <br />Hearing to consider the revocation of Special Use Permit No. 96-07. <br />
