Page three <br />In Steve Renner's memo to Joe Dudash, dated November 7, 2003, Mr. Renner's memo <br />stated that Feature 3, has creosote staining on the surrounding rocks adjacent to feature. <br />The old Clazk-Edwards mine did indeed have a track haulage system in the B seam <br />workings, further evidence that the fire is indeed in the old B seam. <br />In conclusion, the only troubles Beaz Coal experienced with a possible mine fire was near <br />the portal azeas and from the old Clazk Mine workings neaz the portal area. Bear Coal put <br />a tremendous amount of effort and money into the maintenance and monitoring of these <br />seals. It is Beal Coal's opinion that the present fire in an ongoing problem from the old <br />Clazk Mine. It seems like the fire has found a ventilation path to the surface and thus the <br />smoke and heat that is being noticed. Again, in the letter from the Division to Bear Coal, <br />the letter states that it might be necessary for Beaz to conduct further evaluations inside <br />the old mine to determine the origin of the fire, Bear sees no safe or economical way to <br />do this request. The area around the old portals is very unsafe and the mine conditions <br />immediately at the portal azea is extremely unsafe making this request impossible. Again, <br />in Steve Renner's memo, "it appears that this underground fire may be located within a <br />mine that was active subsequent to enactment of the Surface Mining Control and <br />Reclamation Act of 1977: 'Bear Coal feels that this underground fire is probably in the <br />old works of the Clark -Edwards mine and has migrated itself to the surface azea of the <br />C seam portals but if the fire was really active at the time Bear ceased mining operations <br />and sealed is not cleaz. <br />Bear Coal hopes that this information, documents and meeting with the Division has <br />helped to answer some of the questions that have been presented. <br />Since ly, <br />~ ~;c,~=fit! ~'G <br />William A.
