Larson
tiner6Y Fuels Corporation
3 Park Central, Suite 500
1515 Arapahoe
Denver, CO 80202
Dear F1r. Larson:
By letter dated July 24, 1980, Energy Fuels Corporation requested approval to
spoil the Lennox coal seam tiuring mining on Federal coal leases C-22644 and
C-031330. The Acting Deputy Conservation Manager-Flining, responded October 6,
1980, by ordering inergy Fuels Corporation [o discontinue the present and/or
future wasting of Lennox coal from any Federal coal lease held by the
Corporation. Energy Fuels Corporation appealed [he Uctober G, 1980 order to
the Director, U. S. Geological Survey, (USCS) on November 7, 1980.
Energy Fuels Corporation has submitted written and oral information to support
its contention that the Lennox coal seam cannot now be mined at a profit and
that a market does no[ presently exist.
Company officials me[ with the USCS on F~arch 17, 1981, to further review the
issue. Based on information presented, the USCS has reconsidered its position
and now agrees to withdraw the October 6, 1980 order. Withdrawal of the order
by the USGS will allow action by Energy Fuels Corporation [o withdraw its
appeal.
Sincerely yours,
John T. Skinner
Deputy Conservation tfanager-?lining, CR
MAR 2 6 1981
