Larson: <br />By letter dated July 24, 1980, Energy Fuels Corporation requested approval to <br />spoil the Lennox coal seam tiuring mining on Federal coal leases C-22644 and <br />C-031330. The Acting Deputy Conservation Manager-Flining, responded October 6, <br />1980, by ordering inergy Fuels Corporation [o discontinue the present and/or <br />future wasting of Lennox coal from any Federal coal lease held by the <br />Corporation. Energy Fuels Corporation appealed [he Uctober G, 1980 order to <br />the Director, U. S. Geological Survey, (USCS) on November 7, 1980. <br />Energy Fuels Corporation has submitted written and oral information to support <br />its contention that the Lennox coal seam cannot now be mined at a profit and <br />that a market does no[ presently exist. <br />Company officials me[ with the USCS on F~arch 17, 1981, to further review the <br />issue. Based on information presented, the USCS has reconsidered its position <br />and now agrees to withdraw the October 6, 1980 order. Withdrawal of the order <br />by the USGS will allow action by Energy Fuels Corporation [o withdraw its <br />appeal. <br />Sincerely yours, <br />John T.
