Several items came to my attention that re' giY(f{9jtdiate action <br />on Mountain Coal Company's (MCC) part to remain in compliance with Forest Service conditions of <br />approval for these projects. <br />First, the closure gate on the Apache Rocks road has not been removed. MCC has been reminded to <br />remove this gate numerous times over the past few months. I am placing a November 28 deadline for this <br />gate to be removed. If it is not, then we will issue a Violation Notice. <br />Secondly, I am concerned that the Apache Rocks road has not yet been reclaimed to it's prior condition. <br />Berms and soil stockpiles aze still present along the road, and the road has not been narrowed to 10 feet as <br />prescribed. This work.needs to be done, and I request that MCC provide us with the plans for it's <br />completion as soon as possible. <br />Lastly, per discussions held in the field at the GVB drill sites, I am concerned about the road widths as <br />built on the ground. Throughout the GVB approval processes, MCC has indicated a 14 foot road width <br />was sufficient. However, roads widths in place on the ground are oflen l8 to 22 feet wide. I must <br />emphasize that MCC is responsible for informing it's subcontractors of the FS conditions of approval, <br />and seeing to it that the contractors follow these conditions. Future road work needs to be in compliance <br />with the 14 foot road width. <br />1 also need to remind you that complying with the conditions of approval is part of the Forest Service <br />decisions for MCC's activities. Compliance is imperative due [o the high degree of public scrutiny on <br />these projects. Non-compliance may result in a loss of credibility and trust with the public, making future <br />planning processes more difficult. <br />Thank you for your prompt attention to these matters.
