Stream Channel Diversions <br />The drainage from the draw north of the bench was channeled <br />across the former location of Pond No. 1, 150 to 200 feet <br />west of the channel's original location. Due to the location <br />of the stabilized bench, completed during the fall of 1984 as <br />part of the mine bench stabilization project, the north draw <br />needed to be relocated. This wide, 0.8 percent grade channel <br />was vegetated and did not require riprap. This is an <br />ephemeral stream and drains an area of less than one square <br />mile. <br />Hubbard Creek was diverted around Pond No. 1 during the <br />mining operation. With the removal of Pond No. 1, Hubbard <br />Creek was restored to its previous channel. The channel did <br />not require major reconstruction. Up to 2,000 cubic yards of <br />gravel from the pond were used on the reclaimed banks along <br />the creek as additional erosion control. <br />The Division proposes to approve the North Draw permanent <br />diversion. This diversion is consistent with applicable <br />state law, will not diminish downstream water rights and <br />meets the requirements of Rule 4.05.4 (4.05.4(4)). <br />Sedimentation Ponds <br />The Blue Ribbon Mine has constructed three sediment ponds, <br />Pond Nos. 3, 4, and 5. Previously, the site contained Pond <br />No. 1, which has been reclaimed and replaced by Pond No. 5, <br />and Pond No. 2, which was eliminated with the bench <br />stabilization project. The ponds have been designed, <br />constructed and maintained in accordance with the <br />requirements of 4.05.6 and 4.05.9. The location of these <br />ponds can be found in Exhibit H-1 and Exhibit Z. The ponds <br />are located as near as possible to the disturbed area and are <br />not located within perennial streams according to <br />4.05.6(1)(6). <br />Acid-forming and Toxic-forming Spoil <br />The Blue Ribbon Mine extracted coal from the E seam, which is <br />an extremely uniform and clean seam. The underground <br />development waste that was produced was placed at the Red <br />Canyon Mine's refuse disposal area. There was minimal waste <br />material and did not require any special handling 4.05.8(3). <br />Impoundments <br />Refer to the section regarding sediment ponds (4.05.9) <br />G.
