The system recommended a conditional issue, since <br />there were audit debts against Powder River Coal Company, an entity affiliated with Seneca Coal <br />Company. Accordingly, Stipulation No. 36 (above) is placed on the conditional approval of this <br />renewal. <br />On October 13, 2006, the Division submitted to SCC an adequacy review of the renewal application. <br />The requested information was received by the Division on November 15, 2006. Minor changes to <br />the PAP that are proposed for approval with RNS include updated Owner, Officer, and Director <br />information for Peabody Energy Corporation, and an update to the threatened and endangered <br />species list in Volume 9 Tab 11 of the permit application package (PAP). <br />During the permit review process for this renewal application, the Division received an application for a <br />Phase I Bond Release (SL-Ol for the entire permit azea at the Seneca II Mine). This application was <br />received on May 24, 2006 and subsequently approved on February 22, 2007. The bond release reduced <br />the required bond by $3,679,464.00, to its current level of $7,160,042.00. During the bond release <br />process the Division performed an evaluation of the reclamation cost estimate and determined that the <br />bond held ($7,160,042.00) was adequate to assure completion of the remaining reclamation work at the <br />site if the work had to be performed by the Division. <br />Description of the Environment <br />The Seneca II Mine is located in northwest Colorado, approximately nine miles southeast of Hayden <br />in Routt County. The Seneca II Mine lies 7 miles east of the Seneca II-W Mine, Permit No. C-82- <br />057, and 4 miles east of the Yoast Mine, Permit No. C-94-082. See Figure 1 for further detail. The <br />mining azea can be found on the Milner Quadrangle 7.5 Minute Series Map. Elevations at the mine <br />site range from 6,600 feet to 8,100 feet above mean sea level. During active mining operations, the <br />coal from the Seneca II Mine was hauled over county and private roadways by private a hauler to the <br />Hayden Station Power Plant operated by Public Service of Colorado. Operations at the permitted <br />mining azea will involve maintenance and limited reclamation activities only during the new permit <br />term. <br />Geology and Topography <br />The Seneca II Mine is located on the Tow Creek anticline, a local structure within the regional Sand <br />Wash structural basin. The local stratigraphic sequence, in ascending order, is the Mancos Shale; <br />the Mesaverde group, which may be subdivided into the Iles and Williams Fork Formations; the <br />Lewis Shale; and the Lance Formation, all of which aze upper Cretaceous in age. Overlying the <br />Lance Formation aze the Tertiary Fort Union and Wasatch Formations. Quaternary alluvial deposits, <br />generally derived from the Mesaverde Group, are locally present in stream valleys. Recent colluvial <br />slides and slumps may also be present in canyons and gulches throughout the area. <br />SurFcial geology in the area consists lazgely of consolidated sedimentary rock of the upper <br />Cretaceous Mesaverde Group. A veneer of colluvial/alluvial material is present in drainages, and <br />becomes more significant along the major streams in the azea. <br />
