Introduction <br />This document is the decision package prepared by the Colorado Division of Reclamation Mining <br />and Safety (the Division) for the Seneca II Mine Permit Renewal No. 5. This document includes: <br />1) the proposed decision to approve the permit renewal application with one stipulation; 2) a <br />summary which includes a history of the review of the permit application, a description of the <br />environment affected by the operation and a description of the mining and reclamation plan; and <br />3) the written findings of compliance the Division has made as required by the Colorado Surface <br />Coal Mining Reclamation Act. Detailed information concerning the findings of compliance can be <br />found in the Regulations of the Colorado Mined Land Reclamation Boazd for Coal Mining. <br />The Division has received an application for a successive five yeaz permit renewal of Permit No. C- <br />80-005 to conduct surface coal mining and reclamation operations at the Seneca II Mine. The <br />application was submitted by Seneca Coal Company (SCC), and the mine will be operated by SCC. <br />Surface lands within the permit area are privately and state government owned, while mineral rights <br />are held by the United States, the State of Colorado, and private parties. The permit area is in Routt <br />County, Colorado, in lands included within: <br />Township 5 North, Range 87 West of the 6th Principal Meridian: <br />Section 1 & 2: All <br />Section 3: Portions of E1/2E1/2 <br />Section 11: NEI/4,N1/2NW1/4,SE1/4NW1/4,NEl/4SE1/4,NEDiagonal'/zNWI/4SE1/4, <br />and NE Diagonal''/z SE1/4SE 1/4 <br />Section 12: All <br />Section 13: Nl/2N1/2N1/2 <br />Township 6 North, Range 87 West of the 6th Principal Meridian: <br />Section 27: Portions of the following - SE1/4SW1/4, SW1/4SW1/4, SW1/4SE1/4 and <br />SE1/4SE1/4 <br />Section 34: E1/2E1/2, NW1/4NE1/4, portions ofNEl/4NW1/4, portions of SW1/4NE1/4 <br />Section 35: W1/2, Wl/2E1/2, portions of SE1/4NE1/4, portions of EI/2SE1/4 <br />Section 36: Portions ofSl/2S1/2 <br />Township 5 North, Range 86 West of the 6th Principal Meridian: <br />Section 6: Wl/2W1/2SW1/4 <br />Section 7: W1/2NW1/4NW1/4, N1/2SW1/4NW1/4 <br />The permit azea encompasses 3,457 acres, of which approximately 2,250 acres have been disturbed <br />by surface operations. Ownership of the surface by State and private interests is 2434.5 and 1022.5 <br />acres, respectively. Seneca Coal Company is permitted to mine 320.9 acres of federally owned coal. <br />
