Banta, <br />Division Director <br />As we recently discussed, the AML program intends to reclaim an area containing <br />coal waste piles associated with the Allen coal mine that apparently are <br />excluded from the reclamation responsibilities of Wyoming Fuel's permit for the <br />New Elk coal mine on the Purgatoire River. Accompanying this memo is a project <br />narrative and map which indicate the location of our project and describe the <br />proposed work. Please review the information and assess our proposed <br />reclamation work in view of the currently permitted New Elk mine. In <br />particular, please address our proposed removal of subsoil from the permitted <br />refuse disposal area. We hope to cover the regraded coal waste material in our <br />project area with this soil and then revegetate it, but we need to be certain <br />that our activity does not interfere with Wyoming Fuel"s permit. Please return <br />your written review comments as soon as possible, to enable us to finalize our <br />project design and initiate contractor procurement by mid-December. <br />Several years ago we received a memo from Jeff Deckler dated November 27, 1985 <br />stating that Wyoming Fuel's area of disturbance was outside our proposed area <br />of activity. I have included a copy of Jeff's memo with this correspondence, <br />thinking that it might be of value in your review of this matter. <br />
