Decision to Require Revisions to the Permit <br />The Division has conducted a mid-term review under Rules 2.08.3, 2.06.2(a), <br />2.06.3(4), 2.06.5(3), 2.06.7(5) and 3.02.2(4). The review included the <br />Southfield Mine permit application, subsequent revisions, stipulation <br />responses, hydrologic monitoring data, past inspection reports, and on site <br />inspections. The Division finds that certain revisions and modifications are <br />needed to ensure future compliance with the Colorado Surface Coal Plining <br />Reclamation Act and the Regulations of the Colorado Mined Land Reclamation <br />Board for Coai IAining. The following sections detail the revisions required <br />and justification for requiring the revisions. <br />Le al, Financial, Compliance Information - The Division finds that the <br />fo owing information is inaccurate and needs to be updated to reflect changes <br />that have occurred over the past 2 1/2 years. Specifically: <br />1. An up to date certification of insurance must be submitted to show that <br />the mine is currently insured. <br />2. A revised legal description of the permit area will need to be inserted <br />into the permit application showing all areas added as result of recent <br />technical revisions. <br />3. Pages 1 through 3 of the application should be rewritten to reflect the <br />current status of the mine. Items 8, 9, 10, 11, 12, 13, 14, 15 and 16 <br />need to be filled in. <br />Identification of Other Licenses and Permit - The following permits must be <br />update to re ect t e current status o t e mine. <br />1. Are the air pollution emissions permits in the application up to date and <br />do they reflect current conditions and ownership? <br />2. The NPDES permit in the application expired nn March 31, 1985. Please <br />submit for replacement a renewed NPDES permit, also the mine name should <br />be changed in the NPDES permit. <br />3. The Planning and Zoning Department of Fremont County special use permit <br />84-17 will need to be revised to reflect current ownership. <br />4. The county special use permit 81-6 for the coal load-out expired in May <br />of 1984. Proof of an up to date special use permit must be submitted. <br />Operations Plan - An up to date permit boundary map should replace the current <br />map in t~permit application. This should show the current extent of mining <br />within the permit boundary. <br />Soils <br />No problems were identified in the soils section (2.04.9) or the soils section <br />of the reclamation plan (2.05.4). <br />-2- <br />
