Such standards and permit systems shall be <br />premiwd on the distinct differences between oparatione for the on-site <br />reprocessing, and operations for the removal, of abandoned coal refuse end other <br />types of eurfaoe coal mining oparatione. <br />(3) The Secretary o! the Interior may devlee a different standard than any of <br />those set forth in section 515 and section 516 0! the Surface Hininq control and <br />Reclamation Act of 1977, and devise a separate permit system, if he determines, <br />oa a standard-by-standard basis, that a different standard may facilitate the <br />oa-site reprocessing, or the removal, of abandoned coal refuse in n manner that <br />would provide the same level of environmental protection as under section 515 <br />sad section 516. <br />(4) Not later than 30 days prior to the publication of the proposed <br />regulations referred to in this euDSection, the Secretary shall submit a report <br />to the Committee on Interior and Insular Affairs of the United states House of <br />Representatives, and the Committee on Bnatgy and Natural Resources of the united <br />States Senate containing a detailed description of any environmental protectlon <br />performance and reclamation standards, sad separate permit systems, devised <br />pursuant to this subsection. <br />[•2504] <br />SEC. 2504. SURFACE MINING ACT IMPLEMENTATION. <br />(a) Subsidence. (1) Title VII of the Surface Nininq Control and Reclamation Act <br />of 1977 (30 U.S.C. 1291 and following) ie amended by adding the following new <br />section at the sad thereofe <br />"SBC. 720. SUBSIDfiNCB. <br />"(a) Requirements. Underground coal mining operations conducted after the date <br />of enactment of this section ^hali comply with each of the following <br />requirements: <br />'(1) Promptly repair, or compensate for, material damage resulting fmm <br />subsidence caused to any occupied residential dwelling and etructurea related <br />thereto, or non-comawrcial building due to underground coal mining operations. <br />Repair of flamage shall include rehabilitation, restoration, or replacement of <br />the damaged occupied residential dwelling and structures related thereto, or <br />non-commercial building. Compensation shall be provided to the owner of the <br />damaged occupied residential dwelling and structures related thereto or <br />non-commercial building and shall be in the full amount of the diminution in <br />value resulting from the subsidence. Compensation may be acrnmplished by the <br />purchase, prior to mining, of a noncnncellable premium-prepai4 ineurnace policy. <br />"(2) Promptly replace any drinking, domestic, or residential water supply <br />from a well or spring in existence prior to the application for a surface coal <br />mining and reclamation permmit, which hoe been affected by contamination, <br />diminution, or interruption resulting from underground coal mininq operatlons. <br />Nothing in this section shall be construed to prohibit or interrupt <br />underground eonl mining operations. <br />'(b) Aegulatione. within one year after the date of enactment of this section, <br />the Secretary shall, after providing notice end opportunity for public comment, <br />promulgate final regulations to implement subsection (a).•. <br />
