Long <br />Divis~an Director <br />This letter is in response to your letter of July 15, 1992 regarding the two coal storage <br />silos acquired by ARCO from the Denver and Rio Grande Western Railroad and formerly <br />owned by Western Slope Carbon, Inc. as part of the Hawk's Nest Coal Mining Operation <br />situated east of the West Elk Mine operated by Mountain Coal Company. <br />The Division has no plans to perform any reclamation work at the silo facility in the near <br />future, and it is highly doubtful that any work will, if undertaken, occur until Spring of <br />1993 at the earliest. The issues regarding possible permitting of the facility by Mountain <br />Coal Company, the proposal to utilize any remaining Hawk's Nest bond monies to satisfy <br />the performance bonding requirements through some type of escrow arrangement, and the <br />possibility of the Division performing some ancillary reclamation work around the silo <br />facility will all need to be discussed further with Division personnel before specific <br />reclamation plans and permitting options can be finalized. As I am being re-assigned to <br />other duties at the Division, 1 suggest that you contact Mr. Steve Renner, Coal program <br />Supervisor, and/or David Berry, Senior Reclamation Specialist, to reiterate ARCO's position <br />on the issues and begin to come to some agreement regarding the final disposition of the <br />silo facility.
