Box 509 <br />Alamosa, Colorado 81101 <br />Re: Midway and Midway South Pits (Files M-86-086, MA6-156) <br />Dear Mr. Anderson: <br />The Division would like to take this opportunity to summarize our meeting held <br />at our office on February 23, 1988. It is our understanding that a third <br />party wishes to acquire the Midway properties. if this is the case, the <br />followir~g items must be submitted to the Division by no later than March 15, <br />1488: <br />- Completed Succession of Operator forms <br />- A revised mine plan <br />- A revised Reclamation Plan <br />- A bond for the site covering all mining related disturbances at both pits. <br />The Division will require a Financial Warranty in the amount of E1,500.00 to <br />E2,000.00 per acre unless a verifiahle reclamation cost estimate can be <br />provi decl. <br />The Division will accept the permit application prior to the applicant having <br />obtained the legal right to enter, and county approval. If the materials <br />listed above are submitted by March 15, 1988, the Division will recommend <br />that they Cease and Desist order be lifted. The bivision will also recommend <br />to The Esoard that the total assessed civil penalty be reduced by 50%. Please <br />note, however, that if the above materials are not submitted by March 15, <br />1988, the Division may recommend to the Board that further enforcement actions <br />be taken. <br />The Division would like to thank you for your cooperation in this matter.
