Box 908 <br />Grand Junction, Colorado 81502 <br />Re: CBW Builders, Inc. - "Una Pit" - File No. M-80-080 <br />Dear Mr. Dombach: <br />I have researched File No. M-80-080 in order to respond to your letter to <br />Ed Bischoff, dated April 7, 1987. I will attempt to interpret your intent and <br />respond accordingly below. <br />At the present time, CBW Builders, Inc. is the permitted operator for the "Una <br />Pit". As such, they are responsible for adherence to the mining and <br />reclamation plans outlined in permit No. M-80-080. Their status as operator <br />is not changed by a change in ownership of the permit area. It can be changed <br />only be our Board's approval of a succession of operators and transfer of <br />permit from CBW Builders to another person or business entity. This new <br />operator could be your bank or an operator of your choosing (if your <br />acquisition of 80% ownership of the site allows you to control the selection <br />of a new operator). <br />Several forms must be completed and submitted to us in order for the Mined <br />Land Reclamation Board to approve a transfer of this permit. I have enclosed <br />all of these forms and will describe each below. <br />First is a "Request for Transfer of Mineral Permit and Succession of <br />Operators" form. A representative of CBW Builders must sign this form to <br />relinquish the permit, and a representative of the proposed new operator must <br />sign it to acquire the permit (both signatures being notarized). Second, is a <br />Performance Warranty form. This is a pledge to do the reclamation, and it <br />must be signed by the new operator. Third, is a copy of our 112 permit <br />application. The new operator is to complete the administrative information <br />on page two and ignore the rest of the form. Finally, a financial warranty in <br />the amount of $188,168.00 must be completed and submitted. Forms for three <br />options are enclosed: 1) Corporate Surety Bond, 2) Letter of Credit <br />(financial warranty and actual irrevocable letter of credit for use by bank <br />enclosed) and Certificate of Deposit (principal amount to go to Colorado Mined <br />Land Reclamation Division and interest to go back to proposed new owner). <br />Receipt by our Division of a properly completed package of a permit transfer <br />form, a performance warranty, administrative information and a financial <br />warranty will allow us to schedule consideration of a request for transfer of <br />this permit on the agenda of the next regularly scheduled Board meeting. <br />~r~~ <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
