CITY OF <br />BRIGHTON <br />V 22 SOUTH 4TH AVENUE ~ BRIGHTON, COLORADO 60601 ~ (303) 659-4050 <br />RECEIVED <br />September lo, 2002 SEP 1 1 2002 <br />Division of Minerals and Geology <br />Mr. Bruce Humphries, Minerals Program Supervisor <br />Colorado Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RE: 124`h Estates Sand and Gravel Mine (M-2001-085) <br />Dear Mr. Humphries; <br />The City of Brighton has recently purchased a 35-acre parcel, legally described as <br />Roadgate Farms No 1, Lot 1, near Henderson in Adams County, Colorado. This parcel <br />has received approval as a sand and gravel mine to be reclaimed for water storage under <br />DMG 112 Reclamation Permit No. M-2001-085. The Seller has executed an agreement <br />with the City to remove the mineral resources from this historic mine, to provide a clay <br />liner in accordance to DMG's requirements and to deliver the reclaimed parcel to the City <br />for water storage. <br />During the DMG and Adams County permitting processes, the Seller has apparently <br />sought approval of different access routes to the mine site from both permitting <br />authorities. Now the Seller and the City are anxious for mining activity to begin but <br />understand that the mining operator does not have an access route to the site that has been <br />approved by both the DMG and Adams County. <br />On September 6, 2002, the Seller was informed by telephone by your office that approval <br />of an alternate access route to the 124a' Estates site from 120`" Avenue could occur only <br />by way of a permit amendment, often a three to four month process. Unfortunately for the <br />City, the Seller was less than prudent with their timing for the alternative access routes <br />request, although this in no way excuses their error, it would certainly create an <br />unexpected delay for Brighton.
