Stipulation No. 6 <br />THE PERMITTEE SHALL REGULARLY MONITOR THE SURFACE STABILITY OF THE <br />BACKFILLED AREA OF THE MEADOWS N0. 1 MINE, REPRESENTED IN TECHNICAL <br />REVISION N0. 2. THE PERMITTEE SHALL CONTINUE TO SUBMIT THESE <br />MONITORING REPORTS AND A SUMMARY OF SUCH OBSERVATIONS ANNUALLY TO <br />THE DIVISION. SHOULD STABILITY PROBLEMS ARISE THE PERMITTEE WILL <br />RECTIFY SUCH PROBLEMS AS DIRECTED BY THE DIVISION. <br />IV. Revegetation - Rule 4.15 <br />1. The Division approved the use of a reference area which the <br />applicant has selected based on the requirements of Rule <br />4.15.7(3). This reference area is located in a mountain shrub <br />community at the Seneca II mine which is immediately adjacent to <br />the Meadows No. 1 mine. The Seneca II mine is operated by Peabody <br />Coal Company. Sun Coal Company has an agreement with Peabody Coal <br />Company which allows them to share in the sampling and use of data <br />from the reference area. This area was sampled under this <br />agreement in 1986 and is planned to be sampled later this year <br />(1988) and again in 1991. <br />Stipulation No. 9 <br />THE PERMITTEE SHALL USE DATA COLLECTED FROM THE MOUNTAIN BRUSH <br />(SHRUB) REFERENCE AREA AT THE SENECA II MINE TO ESTABLISH <br />REVEGETATION SUCCESS CRITERIA FOR HERBACEOUS PRODUCTIVITY ON THE <br />MEADOWS #1 SITE. <br />2. The reference area will be utilized to determine revegetation <br />success in a manner which the Division finds acceptable. <br />4.15.7(4)). <br />3. The permittee had proposed a triennial revegetation monitoring <br />plan. The Division found this frequency inadequate to successfully <br />evaluate revegetation at the site. It was therefore stipulated: <br />Stipulation No. 10 <br />THE PERMITTEE SHALL CONDUCT REVEGETATION MONITORING IN YEARS 2, 4, <br />AND 7 AFTER SEEDING TO EVALUATE THE SUCCESS OF REVEGETATION. THIS <br />MONITORING SHALL CONSIST OF QUANTITIVE EVALUATIONS OF COVER, <br />PRODUCTION AND WOODY PLANT DENSITY, AND QUALITATIVE DESCRIPTIONS OF <br />SPECIES PRESENT, DIVERSITY, AND CONDITION AND TREND OF THE <br />REVEGETATED AREA. QUANTITATIVE MEASURES SHALL BE TAKEN IN <br />ACCORDANCE WITH METHODS SPECIFICALLY APPROVED BY THE DIVISION, AND <br />A SUMMARY REPORT OF THE DATA COLLECTED AND QUALITATIVE DISCUSSION <br />OF ALL PARAMETERS LISTED ABOVE SHALL BE SUBMITTED TO THE DIVISION <br />BY SEPTEMBER OF EACH MONITORING YEAR. <br />-15- <br />
