SECTION B <br />The following findings and specific approvals are required by Rule 4 <br />Roads - Rule 4.03 <br />Haul Roads <br />The Division proposes to approve the retention of the haul <br />road depicted on Map No. 3 since it is compatible with the <br />approved post-mining land use, and a request for its <br />retention was submitted by the landowner. (4.03.1(1)(f)(i)). <br />The haul road was constructed prior to the Permanent Program <br />permit approval. Prior to mining activities the road provided <br />access to oil wells in the area. The road was modified in <br />order to bring it into compliance with the Permanent <br />Program. After the completion of mining the road was <br />decommissioned in order to leave it in a condition which <br />would promote long-term stability, minimize maintenance and <br />allow easy maintenance when required. Technical revision #2 <br />contains the haul road decommission plan. The plan was <br />approved by the Mined Land Reclamation Board at a formal <br />hearing. During review of the technical revision a question <br />of long-term stability of the road arose. The Division <br />therefore required a monitoring plan in order to document the <br />road's performance after decommissioning the monitoring plan <br />was stipulated as follows: <br />Stipulation No. 11 <br />IN ORDER TO ENSURE SATISFACTORY PERFORMANCE OF THE DECOMMISSIONED <br />ROAD, THE FOLLOWING MONITORING AND MAINTENANCE PROGRAM IS <br />STIPULATED. <br />MONITORING <br />A REPRESENTATIVE OF THE PERMITTEE WILL INSPECT CULVERTS AND <br />THE CONDITION OF THE ROAD ON A MONTHLY BASIS. SUMMARY REPORTS WILL <br />BE SUBMITTED TO THE DIVISION ON ASEMI-ANNUAL BASIS, AND WILL <br />INCLUDE A CERTIFIED REPORT OF SEMI-ANNUAL INSPECTIONS (IN SPRING <br />FOLLOWING SNOWMELT AND IN FALL PRIOR TO SNOWFALL) BY A QUALIFIED <br />PROFESSIONAL ENGINEER. <br />MAINTENANCE AND MITIGATION <br />A. THE PERMITTEE WILL PROVIDE MAINTENANCE OF THE ROAD SYSTEM AT <br />LEAST ON AN ANNUAL BASIS AND OTHERWISE AS NEEDED. MAINTENANCE <br />SHOULD OCCUR IN THE SPRING FOLLOWING SNOWMELT. MAINTENANCE RECORDS <br />WILL BE KEPT AND PROVIDED TO THE DIVISION. <br />B. IF, ON THE BASIS OF ANY REPORT BY THE PERMITTEE OR INSPECTION <br />BY THE DIVISION, THE DIVISION BELIEVES ANY COMPONENT OF THE SYSTEM <br />WILL FAIL OR HAS FAILED, A REVIEW OF THE COMPONENT WILL BE <br />INITIATED TO DETERMINE MAINTENANCE NEEDS, ALTERNATIVES, AND/OR <br />MITIGATION. <br />-13- <br />
