<br />II. SUMMARY OF REVISIONS AND STIPULATIONS <br />Revisions <br />The renewal permit was approved February 14, 2005, and expires January 13, 2008. The only <br />permitting actions processed since the RN-4 decision issuance are Minor Revisions (MR's) 22 and 23, <br />addressed below. <br />MR-22 approval decision was issued May 5, 2005. The revision incorporated a temporary rock <br />storage area within the coal mine waste disposal approved disturbance area, and included a variance <br />from topsoil removal for the temporary rock storage site, pursuant to Rule 4.06.212)(a). <br />MR-23 approval decision was issued August 15, 2005. The revision provided a detailed plan for <br />sediment pond cleanout and sediment handling and placement, necessitated by a high intensity storm <br />event on July 25, 2005, which filled the pond with water and sediment. <br />Stipulations <br />Two stipulations (Stipulation No. 12 and Stipulation No. 32) were attached to the RN-4 permit, and <br />are still in effect. Stipulation No. 12 addresses raptor buffer zones, and Stipulation No. 32 addresses <br />the requirement for documentation of surface owner consent for retention of the privately owned <br />segment of the Munger Canyon haul road, prior to initiation of final reclamation operations. Please <br />refer to the January 7, 2005 RN-4 Findings of Compliance Document (pages 2, 3, 36, 37, 18, and <br />19) for the full text of the stipulations, and explanatory narrative. <br />5 <br />
