Dep <br />In your letter dated February 18, 1980, you indicated that <br />Castle Concrete needed Forest Service Approval for its <br />operations on its north and south placer in a special use <br />permit area. For your information, I am enclosing herewith <br />a special use permit which Castle has been paying the annual <br />fee of $350.00. It is my position that under law a special <br />use permit is in fact an approval by the U. S. Forest Service <br />of mining operations for maintaining and using a storage <br />yard and road and no further approval needs to be had. <br />The North and South placer claims have been operating many <br />years before any Federal regulations, especially the ones <br />effective September 1, 1974. <br />The submission of the initial application materials filed <br />with the Board was made to the Forest Service. Rnclosed is <br />a copy of a letter dated May 10, 1978 from Steven PT. Deitmeyer, <br />District Ranger. Recently, the Ranger inspected the area. <br />We are awaiting the State approval which we understand will <br />be de facto Forest Service approval. The Code of Federal <br />Regulation, Section 252.5 provides a 30 day period after <br />submission to analyze, and an extension period of no more <br />than 60 days time, all such deadlines are long since past. <br />Our materials were submitted on May 30, 1978. However, we <br />have always been able to work with the Forest Service who <br />is our neighbor at all the quarries.
