Weaver <br />Energy Fuels Coal, Inc. <br />-2- <br /> <br />August 29, 1994 <br />It appears that the East PitJFan Road has been reestabhshed to a condition which is equal to or <br />better than the previous condition, and that Southfield should be able to maintain the road without <br />expending effort beyond that which was previously needed. The areas noted above will be <br />improved as soon as the AML Program can make funds available for the work. Please <br />understand, however, that once these specific tasks are accomplished, additional maintenance will <br />be the responsibility of either Energy Fuels or the landowner. <br />The West Pit Road was also examined. This road was reestablished to facilitate pending West Pit <br />reclamation work, and to alleviate any need to enter the West Pit Area through the Southfield <br />facilities. The road is generally graded to catch and convey sediment and water along the road, <br />either to the West Pit Area or to the East Pit drainage. Some minimal grading will be done one <br />time, as final funding allows, along this road to further ensure that typical runoff will not pass <br />over the road directly to the Magpie Channel. Subsequent maintenance will be the responsibility <br />of the landowner. <br />A small amount of sediment accumulation has occurred on the downslope side of the reestablished <br />West Pit Road; however, during our June 2, 1994 onsite meeting, we agreed that this would occur <br />to some degree. At this time, it does not appear that the Magpie Channel will be affected to any <br />significant degree. <br />We understand the concerns conveyed by Energy Fuels, and we are working to accommodate Wose <br />concerns to the extent that we can. Likewise, we hope that Energy Fuels can appreciate the <br />~e ate operating.
