Paul Krabacher of AML stated that we would take <br />note of the incident. I proceeded to tell Jay Wagner of Wagner <br />Construction that the area he would miss is the location of four <br />(4) methane wells located on a steep and rocky road. I pointed to <br />the location of the road and mentioned that a map could be located <br />in the bid specifications. The road could be seen from the area of <br />the pre-bid meeting. I also mentioned to Jay Wagner that the <br />sealing method to be used is very straight forward and in the bid <br />specifications. The site showing of the wells was to show access <br />more than the wells themselves. I did not indicate that leaving <br />would present a problem at any time during our conversation. Paul <br />Krabacher of the AML program also attended the pre-bid meeting and <br />he did not indicated to Jay Wagner that leaving early would present <br />a problem. The Division essentially gave it's "consent" to the <br />contractor to leave early by explaining the condition of the road <br />and not informing the contractor that this would be a rejection of <br />his bid. <br />Please also note that this part of the site showing was very <br />minimal. The Division drove with several contractors to the <br />location of one well to give the operators an idea of the <br />condition. In the overall significance of the job, this part was <br />very low on the priority list. At one point during the pre-bid <br />meeting, Jay Wagner stated that he would probably drive up the road <br />on his way out of the mine site area. I do not know if Jay Wagner <br />did drive up the road. <br />Leaving the pre-bid meeting with the "consent" at the time of the <br />meeting does not appear to be sufficient cause to reject the bid. <br />Please contact me if you have any additional questions. <br />c:\hawk\940906 <br />
