<br /> <br />Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve with stipulations an <br />application for a Permit Revision (PR-03), Eastern Mining District, which proposes only <br />underground mining in all or portions of Sections 13, 14, 20, 21, 22, 23, 24, 26, 27, 28, and 29, <br />TSN, R86W. As shown on Map 23, Mine Plan, of the permit revision application, during the <br />current 5 yeaz permit term (1993-1998), the North mains will be advanced to the north-northwest <br />into section 17, TSN R86W. Submain development mining will occur in a southeasterly direction <br />in Sections 28 and 29, gateroad development mining will occur in gateroads SR through lOR along <br />their entire length, as well as 1000 feet into gateroads 4R through 2R, and longwall mining will <br />occur in panels 7 Right through 9 Right. A detailed text description of the mine plan approved <br />under PR-03 is included in the permit application on page 2.05-3(b)(1). Coal to be mined in the <br />Eastern Mining District approved under this application includes Federal coal in the Wadge seam <br />in leases C-081330 and COC-54608, State coal in leases CO-3229 and CO-609, and private coal in <br />portions of Sections 20, 22, 24, 27 and 28, TSN R86W. Coal Ownership is shown on Map 2 of <br />the permit application. <br />This decision is based on a finding that the operations will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request for a forma] <br />hearing is made within thirty (30) days of the first publication of the issuance of this proposed <br />decision, then this decision becomes fmal. Upon submittal of acceptable surety by the applicant, <br />the permit revision. may be implemented. The permit revision application, all supporting <br />documentation and any stipulations or conditions will become a binding part of the permit. The <br />active stipulations are specifically outlined on page 11 of this document. <br />2 <br />
