Lung <br />Division D~rectrn <br />RE: Right of Entry and Land Ownership, <br />Rimrock Coal Company, <br />Rimrock Strip Mine, Permit No. C-89-074. <br />Deaz Mr. Kerr: <br />Section 2.03.4 of the Rimrock permit indicates that the surface owner of the lands <br />included within the permit area and all areas contiguous to the permit azea is Mr. Mark <br />Jung. The Division's copy of Map 8, "Ownership", indicates that the permit area and the <br />lands contiguous with the permit area are owned by William T. and Lucy G. Davis. <br />Pursuant to Rules 2.10.3(1), (2) and 2.03.6(1), please submit an MR containing an <br />updated and certified ownership map and a copy of the document upon which Rimrock <br />Coal Company bases their legal right to enter and conduct reclamation operations in the <br />permit azea. Please submit the required MR by January 16, 1995. <br />Below, I have included the referenced rules. <br />2.10.3(1) In addition to arty other maps specifically required by Rule ~ the permit <br />application shall include maps showing: <br />(a) All boundaries of lands and names of present owners of record of those lands, <br />both surface and subsurface, included in or contiguous to the permit area; <br />(b) The boundaries of [and within the proposed permit area upon which the <br />applicant has the legal right to enter and begin surface or underground mining <br />activities; <br />2.10.3(2) Maps, plans, and cross-sections included in the permit application which are <br />required by 2.1 D shall be prepared by or under the direction of, and certified <br />by, a gtutltfied registered professional engineer or professional geologist, with <br />assistance from experts in related fteWs such as land surveying and landscape <br />architecture and shat! be updated by the permittee as required by the Division. <br />
