Proposed Decision <br />The Division proposes to approve Walden Coal Company's request for bond <br />reduction. Specifically, the Division proposes to reduce $117,900 from the <br />existing 8214,400 reclamation bond leaving a bond of E96,500. This request <br />was made by Walden Coal Company in accordance with Rules 3.02.2(41(dl and <br />3.03.2 of the Regulations of the Colorado Mined Land Reclamation Board for <br />Coal Mining and Colorado Surface Coal Mining Reclamation Act, C.R,S. <br />34-33-101, et. seq Section 113 and 125. <br />The Bourg Mine is located five miles northeast of Walden on privately owned <br />surface and coal in the S1/2 SE 1/4, Section 7 and N1/2 NE 1/4, Section 18 <br />Township 9N, Range 78W of the 6th P. M. The loadout is located one mile north <br />of Northgate in the S 1/2, NE 1/4 of Section 31, T11N, R79W of the 6th P.M. <br />Both are located within Jackson County. These areas are contained within the <br />Eagle Hill and Northgate 7 1/2 minute USGS quadrangle maps. <br />The amount of the retained bond is derived from costs associated with the <br />abandonment of two wells, mitigation for erosion and re vegetation activities. <br />Bonding for revegetation assumed 100% vegetative failure and consequently <br />includes the costs of soil Dreparation, seeding, fertilization and mulching. <br />The bond reflects the costs anticipated by the Division if the Board had to <br />perform reclamation using independent contractors. This bond is greater than <br />the bond proposed by Walden Coal Company and differs in the costs assigned to <br />erosion mitigation, vegetative failure and job supervision. <br />Bond reduction is being granted on the basis of replacement of topsoil at the <br />mine and loadout. There are 105 acres of disturbance at the Bourg Mine and <br />2.82 acres of disturbance at the loadout within the 162.82 acre permit area. <br />This proposed decision is based on a site inspection conducted November 7, <br />1990, as well as review of the monitoring and permit files, and information <br />submitted by Walden Coal Company concerning volumes of earthwork. <br />CWB/yjb <br />1906E <br />-2- <br />
