<br /> <br />BY DECEMBER 3l, 2001, LORENCITO COAL COMPANY WILL SUBMIT A <br />TECHNICAL REVISIUN TO THE PERMIT INCORPORATING A PLAN TO <br />DISPOSE OF UNDERGROUND MINE DEVELOPMENT WASTE IN ABANDONED <br />WORKINGS. THIS REVISION WILL ADDRESS ANY AND ALL ISSUES AS <br />IDENTIFIED IN QUESTION 72 OF THE DIVISION'S INITIAL ADEQUACY <br />REVIEW AND AS REQUIRED BY RULE 2.05.3(9). THIS SHALL INCLUDE A <br />PLAN FOR EXTINGUISHING FIRES IN THE COAL MINE WASTE AS REQUIRED <br />BY RULE 4.l l.l. NO COAL MINE WASTE MAY BE DISPOSED ON IN <br />ABANDONED WORKINGS PRIOR TO RECEIVING FINAL DIVISION <br />APPROVAL OF THE REVISION. <br />Underground mining is no longer proposed or approved under this permit. Therefore, <br />this stipulation is terminated. <br />Summary <br />The Review Process <br />Lorencito Coal Company, LLC, submitted an application for a permit revision (PR-O1) on May <br />l 0, 2001. The mine will be developed on portions of 3, 142 acres of the Hill Ranch, located <br />approximately 22 miles west of Trinidad, Colorado in Las Animas County. The application <br />was submitted by Greystone Development Consultants on behalf of Lorencito Coal Company. <br />The application was reviewed by the Division and found incomplete. On May l8, 2001, the <br />Division notified the applicant of the incomplete determination and identified items necessary <br />to make the application complete. The applicant responded with an additional submittal on <br />May 22, 2001 and the application was then found complete on May 29. Notification of the <br />filing of a complete application was forwarded to the applicant on May 30, 2001. This <br />notification was sent to the appropriate governmental agencies, including the Division of <br />Wildlife, Las Animas County Planning Office, Las Animas County Commissioners, State <br />Historic Preservation Office, Water Quality Control Division, Air Pollution Control Division, <br />Natural Resources Conservation District, and the Office of Surface Mining. The United States <br />Fish and Wildlife Service (USFWS) was notified on May 31, 2001. <br />Public notice announcing the filing of a complete application was done in the local newspaper, <br />The Chronicle-News, on June 4, June 11, June 18, and June 25, 2001. The Division queried the <br />Applicant Violator System (AVS) on June 12, 2001. The system returned a recommendation of <br />"Conditional Issue". <br />On June 1 1, 2001 the Division received a letter from SHPO identifying sites requiring <br />additional testing and granting clearance for other sites to be affected. On June l2, 2001, this <br />letter was forwarded to the applicant along with a recapitulation of previous surveys and sites <br />identified. <br />
