<br />Proposed Decision <br />The Colorado Division of Minerals and Geology (DMG) approves an application for a permit <br />revision (PR-Ol) to conduct surface coal mining operations. Operations are approved as noted <br />in these written findings and as shown on Map 2.05.3- 2, 5-Year Mine Plan. The area <br />approved for mountaintop removal operations is as depicted on the map for the years 2001 to <br />2005. Haul roads included in the approval are the Lorencito Canyon haul roads LCI, LC2, <br />LC3, and LC4. The Jeff Canyon haul road was previously approved via technical revision no. 6 <br />(TR-06). Contour mining operations are approved as areas labeled P2-P7 on Map 2.05.3-2. <br />The area shown east of P7, not shaded for year 5 mining, is not approved under this permit <br />revision, nor is the extension of haul road LC3 to this mining area. A raw coal loadout is <br />approved and will be located along the existing railroad track at the mouth of Lorencito <br />Canyon. <br />This decision is based on a finding that operations conducted by Lorencito Coal Company will <br />comply with all requirements of the Colorado State Program as found in the Colorado Surface <br />Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations promulgated <br />pursuant to the Act. If no request for a formal hearing is made within thirty (30) days of the <br />first publication of the issuance of this proposed decision, then this decision becomes final. <br />Upon submittal of acceptable surety by the applicant, the permit revision will be anal. The <br />permit application, all supporting documentation, and any stipulations or conditions will <br />become a binding part of the permit. <br />Stipulations <br />No stipulations were issued as a result of this permit revision approval. However, stipulations <br />were issued under the original permit approval for this mine and the status of these stipulations <br />after this approval is outlined below. <br />STIP # 4 <br />LORENCITO COAL COMPANY SHALL CONDUCT CULTURAL RESOURCES <br />SURVEYS, SUBMIT THE SURVEYS TO THE DfVIS1ON, AND RECEIVE SHPO <br />CLEARANCE PRIOR TO DISTURBANCE OR CONSTRUCTION ACTIVITIES <br />ASSOCIATED WITH THE P1/P2 HAUL ROAD, P1/P2 ACCESS ROAD, AND THE <br />P1/P2 BOX CUT, PORTAL, AND TEMPORARY OVERBURDEN STOCKPILE <br />AREA. <br />Considering the change to the mine plan as proposed and approved under this permit <br />revision, this stipulation is no longer necessary. Underground mining is not part of the <br />approved mine plan at this time. Surface mining road corridors have received approval <br />
