I had mentioned during our phone <br />conversation, that a question arose during MCC's discussion of this technology of the <br />applicability of Rule 4.09.1, which states that "All excess spoil shall be transported to and placed <br />in designated disposal areas within a permit area...". As such, I had asked you if MCC must <br />gather this material for disposal in MCC's waste pile. You stated that due to the small amount of <br />material that will be sent for testing and the fact that MCC is sending it to a commercial facility <br />for testing (similar to sending coal samples to the lab for coal quality) MCC need not retrieve this <br />waste material. In addition, you said that you would assume that the company doing the testing <br />operated under some approved disposal plan. The samples will be sent at the end of this week or <br />early next week. <br />Please call if you have any questions.
