<br /> <br />testing and sieve analysis referenced in the Supplement on p.3 and Appendix B attached <br />thereto; additional geology data collected from current and former representatives of <br />other companies working in other pits in the same area as the Haldorson permitted area <br />who have stated that groundwater in their pits was not encountered until depths of at <br />lease 40-50 feet from the surface of their companies pits, Supplement at p.4 and <br />appendix C thereto; and data showing a shale ridge along the southwest corner of the <br />permit are and indicating that groundwater cannot infiltrate to the permit area from <br />outside the permit area, Supplement at p. 3 and Appendix B thereto. <br />CONCLUSION <br />For the forgoing reasons, DMG requests that the Board reconsider its October <br />2003 decision regarding the Haldorson permit and revise stipulation 2 to indicate that <br />Halderson may excavate in Phase I during the first year down to 13 feet while continuing <br />to monitor as established in Haldorson's monitoring plan. DMG has no objection to the <br />Board setting a "trigger" point for certain monitoring well(s), which, if groundwater <br />reaches such level Haldorson would be required to cease excavation activities until the <br />groundwater "trigger" level recedes or other mitigation measures acceptable to DMG <br />have been implemented. <br />2004, <br />Respectfully submitted this first day of March, <br />
