Box E <br />Paonia, Colorado 814L8 <br />Re: Comments on Stipulation No. lti Response for Orchard Valley Mine - <br />Refuse Pile <br />Permit C-U38-81 <br />Dear Ms. Gordon; <br />The Division has completed its review of CWI's December 28, 1982 waste <br />pile designs submitted to satisfy Stipulation No. 16 of the Orchard <br />Valley permit. <br />Attached to this letter are the Division's comments on Drainage and <br />Sediment Control, 8ackfilling and Grading, and Roads. Also, attached is <br />a memo from Jim Pendleton of our staff which addresses the stability <br />aspects of the plan. <br />Although the Division has reviewed and commented on Phases I, II and III <br />of the plan, our intention will be only to approve Phase I at this time. <br />This is because the plans for Phases II and III are labelled "conceptual" <br />and are not final. CWI may pursue resolution of concerns with Phases II <br />and III now or at any time in the future. <br />Prior to the Division's approval of Phase I, CWI will need to respond to <br />the attached concerns pertaining to that site. There is no timetable <br />imposed for your response. However, the items must be resolved prior to <br />our approval and your initiation of construction at the site. <br />The submitted plan contained some items pertaining to topsoil handling. <br />The information concerning topsoil was not reviewed, since the final <br />complete topsoil plan is to be submitted later, in response to another <br />stipulation. <br />423 Centennial Building, 1313 Sherman Straet Denver, Colorado 80203 Tel (301) 885-7587 <br />
