Mr. Mautz is alleging
that MCC has damaged a spring to which he has water rights. This
spring is in the Lone Pine Gulch drainage in the NW ; of Section
20. I am still in the process of determining whether the spring is
truly a decreed spring and whether mining induced subsidence caused
any damage to the spring.
It is with these two issues that I am requesting your assistance.
It has been brought to my attention that Bear Coal Company is
mining in Section 17 close to the Section 20 line. Bear's angle of
draw apparently includes a portion of Section 20 and possibly the
spring in question. Is it possible that Bear may have impacted
this spring? I also would like to know what springs in this area
Bear is currently monitoring, to determine whether Bear has been
monitoring the spring in question.
I would like to go over this information with you at your earliest
convenience. Perhaps some time next week? Please let me know when
you would be available.
cc: David Berry
007CTZ.SSS
