Banta, <br />Division Director <br />The Division has reviewed the responses to Stipulations 18 and 20, submitted <br />in a timely manner on June 18, 1991. Additional information 1s necessary in <br />order to process these submittals as revisions to the approved permit <br />application document. <br />The response to Stipulation 18 must be handled as a minor revision. As such, <br />the discussion of topsoil storage volumes and replacement depth on Page 4-53 <br />must be updated to reflect the results of the recent survey. Additionally, <br />the volumes should be placed in an Exhibit or Appendix where it can be easily <br />located and referred to in the text. <br />The materials submitted on the design of the coal waste disposal facility must <br />be Incorporated into the permit as a Technical Revision as defined in Rule <br />1.04(136). As such, NCIG must submit a proposed public notice according to <br />Rule 2.08.4(5)(b), and the design must be in a form that can be readily <br />incorporated Into the permit application document. As described above, <br />placing the submittal in an. Exhibit or Appendix to be mentioned in the text <br />would be one acceptable approach. Until these requirements are met, the <br />Division is unable to deem the revision complete and to proceed with a <br />technical review. <br />
