plan. A "Findings of Compliance" was issued on October 12, 1986,
superseding the findings proposed on June 20, 1985 for Permit No.
C-83-038. The document also took into consideration any
stipulation imposed on Permit C-83-038 by reiterating those
stipulations that still applied.
On November 5, 1987, Colorado Westmoreland Inc.'s application for
renewal of a valid and existing permit to conduct coal mining
operations, Permit No. C-038-083, was deemed complete. The
Division published its proposed decision to approve the renewal
with ten stipulations on August 4, 1988, and amended the permit
decision of March 21, 1983 by renumbering the permit as C-81-038 to
ensure consistency with the MLRD files. Permit C-81-038 was issued
by the Division on July 21, 1988. This date was in error; the
permit issuance date should have been April 20, 1988. This
situation was remedied by back dating the 1993 permit renewal
issuance document to April 20, 1993, thereby designating a five
year permit expiration date of April 20, 1998.
The Division issued a decision on August 10, 1989 to approve the
transfer of mining permit C-81-038 from CWI to Cyprus Orchard
Valley Coal Corporation (COVCC).
On May 17, 1993, the Division approved Technical Revision No. 22,
which incorporated sixty additional acres into the Orchard Valley
Mine permit area on the west boundary. This incidental boundary
change was approved to modify the permit area boundary such that it
would encompass the angle of draw projected to the surface from the
mine workings proposed for coal lease COC-37210M.
On January 22, 1993, COVCC's application for Permit Renewal No. 2
was deemed complete. A proposed decision to approve the renewal
with seven stipulations was issued on July 23, 1993. On April 28,
1993, COVCC submitted a permit revision (PR-03) to incorporate 510
additional acres into the permit area from the newly acquired Coal
lease COC-53356. The revision was approved on July 30, 1993 with
ten stipulations.
On December 8, 1994, an application for a succession of operator
and transfer of permit was received from Bowie Resources, Inc. The
application was found to be complete and on January 24, 1995,
Permit No. C-81-038 was transferred from Cyprus Orchard Valley Coal
Corporation to Bowie Resources, Inc.
Since the last permit renewal there have been five notices of
violation issued to permit no. C-81-038 as follows:
C-93-142 was issued to COVCC on October 18, 1993 for failure to
