If any permit application documents are sent to the <br />Service for review for future activities on the West Elk Mine you should state <br />that the surveys for the above plants and animals have been conducted and <br />refer to the survey report. The Service will have to make a determination at <br />that time, based on your past survey efforts, length of time since the last <br />surveys, and whether a plant or animal is federally listed whether surveys <br />will be required. <br />The Service appreciates your survey efforts to date and hopes that you will <br />consider protection..of candidate species in the future to help prevent moving <br />them towards listing. However, the Service can not require surveys or <br />protection measures for candidate species. <br />The Service apologizes for taking so long to respond to your letter but other <br />priority deadlines have precluded us from responding earlier.
