For that reason, in our meeting with CC&VG and Golder personnel on October 13th, I repeatedly emphasized the importance I placed upon compliance with the visual monitoring. You, Carl Mount and Mike Long were in attendance at that meeting and should recall my specifically cautioning CC&VG and Golder as to the reliance I placed on their compliance with this condition in completing my opinion to recommend approval. Having now been informed that CC&VG's Contractor and CQA agent both decided to ignore this condition, which is simple to implement by merely instructing the dozer operators never to proceed without the appropriate personnel in attendance, I face an untenable situation. Because I now have no ability with which to confidently conclude that the drain cover material is being properly installed at.the Cresson Mine, I conclude that I am left with no alternative but to recommend to you that the Division immediately rescind our approval of the size gradation change granted for the areas outside the "Pregnant Solution Storage Area" of the Cresson Phase One Heap Leach Pad. Further, I recommend that we direct CC&VG to remove and replace the drain cover material placed on the entire panel in question under appropriate monitoring and control procedures. In addition, I recommend that the Division inform Golder Associates Inc. that we are unable to understand how they will be able to certify the drain cover material placed on the panel in question.
