Stipulation 20 directs WECC - ; <br />"as a portion of its subsequent permit applications for the <br />mine to submit a revised subsidence evaluation. The subsidence - ., <br />" - evaluation for the next permit period shall incorporate the <br />results of subsidence monitoring and the landslide stability. <br />studies stipulated above in designated refined safe areas ~ "' <br />buffer boundaries to be observed in the future mining beneath <br />'• critical areas, including the Dry Fork of Minnesota Creek, ~ "' <br />Beaver Reservoir and the landslide deposits adjoining it. The <br />amended subsidence evaluation shall include the proposal of <br />- appropriate subsidence monitoring networks. within each of these <br />critical areas." <br />As you know, WECC has not yet retreat-mined any panels. Retreat- ~ <br />mining of the first panel (the subsidence test panel in Section 20)- - <br />will likely be done sometime during-the first half of 1986. Given .R <br />" _.. ~ that the application for renewal of the next.5-year permit will be " <br />-. submitted in 1986, WECC will not have had the opportunity to collect - <br />subsidence data with which to prepare a subsidence evaluation. - <br />Thus, it would be appropriate to revise this. portion of. the _ <br />Stipulation to state that as part of the permit application to <br />.. ~ undermine critical areas, including the Dry Fork of Minnesota Creek, <br />Beaver Reservoir and the landslide deposits adjoining.it, a revised <br />subsidence evaluation will be submitted. <br />Finally, since WECC will not be undermining the landslide deposit in <br />" Section 17, having assigned all of the coal in Federal Lease C- <br />0117192 in Section 17 to Bear Coal Company, landslide stability " <br />studies incorporating the influence. of subsidence as required in <br />Stipulation 20 is~ no longer appropriate.
