<br />FIELD INSPECTION <br />Field inspection of the Block C acreage was conducted on July 26, 1994. In attendance <br />representing the Office of Surface Mining was Joe Wilcox, Dalen Figgs, and Edsel Pugh. The <br />operator was represented by Gail Noonan and Marcus Middleton of Twenrymile Coal Company. <br />David Berry and Kent Gorham of the Division of Minerals and Geology were also present. <br />Janet Hook of the Bureau of Land Management did not accompany the group on the Block C <br />inspection since no Federal surface was involved in Block C. <br />Following the field inspection conducted in accordance with Rule 3.03.2(2), the Division <br />determined that one outstanding issue remained to be addressed by the operator prior to a <br />decision. Three livestock ponds, OSP-C, 31-c, 31-g, exist on or within Block C. During <br />livestock pond certification conducted in September of 1993, repair work and pond modifications <br />were proposed. The Division determined that the repair work and/or modifications as specified <br />in the pond certification process would need to be completed prior to a decision. On October <br />7, 1996, the operator submitted a certified statement indicating that the repair work, as specified <br />in the September 1993 certification had been completed on ponds 31-c and 31-g. Pond OSP-C <br />was removed by the operator entirely due to a lack of water-holding ability. Therefore, the <br />operator has successfully addressed the single issue identified during the field inspection of <br />Block C. <br />SUMMARY <br />In summary, CYCC has completed the reclamation plan for Block C as currently approved in <br />the permit. The affected lands have been successfully restored to the approved alternate land-use <br />of pastureland. The area is utilized by a wide variety of wildlife including deer, elk, sandhill <br />cranes, sage grouse and a host of small birds and mammals. The forage value of the land <br />greatly exceeds that of native pasturelands and will support domestic livestock and wildlife <br />grazing. Revegetation success criteria have been achieved and the lands are stable, revealing <br />no evidence of erosion, slides, or damage. There is no remaining reclamation to be completed <br />within the area delineated as Block C. The Division approves this Phase II/III request for Block <br />C of the Mine 1, Mine 2, and Eckman Park mines, permit no. C-81-071. <br />Any person with a valid, legal interest which may be adversely affected by the proposed decision <br />of the Division or the head of any Federal, State, or local government agency which has <br />jurisdiction by law, has the right to an adjudicatory hearing as outlined under Rule 3.03.2(6). <br />The request for an adjudicatory hearing must be written and state with specificity the reasons <br />why the hearing is requested and must be received within 30 days of the first publication of the <br />proposed decision by the Division. <br />References <br />Principles and Procedures of Statistics, Robert G.
