To make <br />clear tM aestivation for CM Resource Area designating this existing operation <br />as a easssunity pit one needs to be aware o! ehe history of tM operation and <br />its current status. Mhat follows i• a sus~ary of tM relevant faet• which <br />•AOUld make clear the just ifieation for the community pit. <br />The liavston• quarry site ra• originally permitted under the State Mined Land <br />Reclama[ion Division (nor tM Division of Mines end Geology) •s mine permit <br />No. 82-121, issued to Mid-Continent Resources, Inc. in 1982. Pit kin-Iron <br />Corporation was the designated operator of the quarry. The quarry ra• sited <br />on 13, 20-acre lode claims (the Tiger^ Nos. 2-6, Lyra Nos. 2-6, and Lien <br />Nos. 2-4) held by CiGI Corporation and leased to Nid-Continent Resources. <br />Nid-Continent's primary market for the quarry was as s supply of loeatable- <br />grade limestone to the company's rock dust plant in Carbondale, Colorado where <br />the rock was pulverised and sold as rock duet for coal mines. A large captive <br />market for this use existed in the form of Mid-COntinent'• own coal mince <br />within it^ Coal Basln Nine^ Complex most of Redstone, Colorado. Mid-Continent <br />•lso marketed locatable grade limestone to the Craig power station for use •s <br />• sulfur dioxide •ervbDinq agent. ~'3ince the locatable grade limestone had to <br />De selectively mined from a much lar'gar section of man-locatable limestone and <br />waste rock, the operation did generate a considerable quantity of material <br />that could not be directly marketed under the mining laws._ In accordance with <br />• Solicitor's Opinion on this type of vests material, this office did allow a <br />certain tonnage of this waste material to be disposed of by Mid-Continent, <br />royalty-tree, for non-qualif yinq end-uses. This tonnage wa^ tied to the <br />requirement that the waste material only be generated through the neeessery <br />
