To date, Mr. Kehn has still not fulfilled the obligations of his conditional approval
granted by the Board of County Commissioners to mine his property. Until the conditions are
completed, vve do not consider the property to be validly permitted by County regulations for
mmmg.
I know that tnany of the documents which are reviewed for a mine are reviewed solely by the
State, by your office. I noticed in the Clerk and Recorder's office several submittals by Mr.
Kehn since his original submittal in 1992. These were in 1993 and in 1994. Unfortunately, I
am not as well versed in how the State's permitting process works and am therefore, not exactly
sure what questions to ask you about permit #M89-056. I would like to know any specifics
related to when he can begin mining according to your regulations, what his approved (by your
office) reclarnation plan is, and what consequences there may be for this mining operation from
yow office, if any, if he has not completed his conditions of approval set forth by the County
Commission°rs. Any other information that you could relay to me about this operation
specifically and about MLRB permitting processes in general would be greatly appreciated.
Thank you fur your assistance with this matter. I really appreciate it. If you have any questions
or wish to disocuss this matter, please call me at 498-7692.
Richael~i~ i h.el~~~~~~
Planner
cc: File # 92 .?ROl I
David Korth, <:ode Enforcement Officer
BOARD OF COUNTY COMMISSIONERS
John Clarke Janet Duvall Jim Disney
District I District II District III
