Heifner <br />37 East Colorado Avenue <br />Denver, Colorado 802 l0 <br />Re: Castle Concrete Company's "Sand Pit" Amendment <br />E1 Paso County, File No. M-17-213 <br />Dear Mr. Heifner: <br />The application for an amendment of the above-captioned operation was received <br />by the Division and deemed complete on April 1, 1985. It is noted that <br />publication (one time a week for four consecutive weeks) has begun. The <br />following must be submitted prior to the June 26-27, 1985 Board consideration <br />of the amendment: <br />1. Proof of the remaining three weeks of publication <br />2. Proof that a copy of the publication was either personally served <br />or sent by certified mail (with return receipt requested, where <br />possible) to: <br />a. All owners of record of surface rights to the affected land, and <br />b. All owners of record of immediately adjacent lands. <br />The following issues require clarification, however: <br />Exhibit D - Mining Plan <br />1. Exhibit D states that the entire 34.7 acres will be utilized as an <br />"open pit sand extraction operation". Please delineate the acreage <br />of affected land, and that land involved in right-of-way easements. <br />2. As stated in a previous conversation, Castle Concrete Company is <br />responsible for the relocated ditch construction. Please provide <br />proof of agreement between Castle Concrete Company and: <br />a. The Fountain Mutual Ditch Company detailing the easement <br />agreement and Castle Concrete Company's planned compensatory <br />measures if the ditch is damaged; and, <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
