.. ,:. <br />STIPULATION NO. 28 -- WITHIN SIX MONTHS OF PERMIT ISSUANCE AND PRIOR <br />TO ANY SURFACE DISPOSAL OF COAL MINE WASTE, THE PERMITTEE WILL <br />IDENTIFY THE SOURCE OF AN APPROPRIATE VOLUME OF SUITABLE NON-TOXIC, <br />NON-COMBUSTIBLE COVER MATERIAL TO BE PLACED OVER THE GRADED <br />REFUSE PRIOR TO TOPSOII,ING, PURSUANT TO RULE 4.10.4(5). UNLESS ANALYSES <br />ARE PROVIDED WHICH DEMONSTRATE A LESSER COVER THICKNESS WILL <br />ALLOW FOR SUCCESSFUL RECLAMATION, THE PLAN WILL SPECIFY THAT A <br />MINIMUM COVER THICKNESS OF FOUR FEET WILL BE PLACED ON THE GRADED <br />REFUSE. <br />ALSO WITHIN SIX MONTHS OF PERMIT ISSUANCE, A DETAILED DESCRIPTION OF <br />ANY PROPOSED COAL MINE WASTE DISPOSAL WITHIN ABANDONED WORKINGS <br />SHALL BE PROVIDED, PURSUANT TO RULE 2.05.3(9)(a) AND (b). DOCUMENTATION <br />OF MINE SAFETY AND HEALTH ADMINISTRATION APPROVAL OF DISPOSAL <br />WITHIN UNDERGROUND WORKINGS WILL NEED TO BE PROVIDED, PURSUANT TO <br />RULE 4.11.3. <br />Status -The stipulation was resolved based on permit narrative included in TR-09 which <br />indicates that any rock waste generated by underground operations will be disposed of <br />within the mine, and will not be brought to the surface. Additional explanatory <br />information is included in a January 10, 1998 letter from John Walters of GVCC to Dan <br />Mathews of the Division. The letter clarifies that waste generated during the normal <br />course of mining operations, such as roof fall material, would be disposed of underground, <br />in accordance with standard industry practice, and in compliance with applicable MSHA <br />requirements. Because no new portal development or rock tunnel development is <br />proposed, no production of underground development waste is projected, and the <br />amended plan was deemed acceptable. <br />Stipulation Resolved and Terminated <br />STIPULATION N0.29 -WITHIN THIRTY DAYS OF PERMIT ISSUANCE, THE <br />OPERATOR WILL SUBMIT A PLAN FOR TEMPORARY STORAGE AND FINAL <br />DISPOSAL OF NONCOAL WASTES PURSUANT TO RULES 4.11.4(1), (2), AND (3). <br />Status -The stipulation was adequately addressed by amended permit narrative included <br />within TR-09.
