CWI has accepted all stipulations attached to the permit with <br /> the understanding that StipL.ation No. 26 is specifically in reference to occu- <br /> pied dwellings, and not gener'A1 surface lands. <br /> 27 <br /> Though we have accepted and will comply with Stipulation No. .2'K with the above <br /> understanding, CWI does not believe that the stipulation is necessary, as it <br /> is repetitive of the regulations. Because Mike Long of the Division has told me <br /> that Stipulation No. 26 and the regulations speak only to those surface lands <br /> containing useful dwellings, CWI will accept and comply with the stipulation. <br /> As stated in the Buildings section of the Subsidence Repair Handbook in Volume 3 <br /> of CWI' s permit, solid coal blocks of 300-foot radius will be left below occu- <br /> pied dwellings. This radius may be adjusted with the consent of <br /> owner. In this manner, CWI is in compliance with this stipulation and the regu- <br /> lations. <br /> Also attached is a rider to CWI' s reclamation bond CA) reducing <br /> the amount as approved to $1, 979,000,00. Please have both the original and the <br /> copy signed. Return the copy to me for our records. To cancel reclamation bond <br /> No. 64S1DO3O70D8BCA, which was originally issued for the OVWM pipeline separate- <br /> ly, but is now included in the enclosed rider, please return the original bond <br /> to CWI or prepare a letter authorizing the cancellation. <br /> Please don' t hesitate to contact me or Kathy Welt should you have any ques- <br /> tions. <br /> Sincerely, <br /> COLORADO VESTMORELAND INC. <br /> Ronald W.
