<br />Inc. ("Stollberg"), will be heard by the Honorable Judith A.. <br />Boulden, United States Bankruptcy Judge, on Wednesday. SeotEamber <br />29, 1993, at the hour of 3:00 n.m., or as soon thereafter as; <br />counsel may be heard, in Judge Boulden's Courtroom located on the <br />third floor of the Federal Courthouse Building located at 3°.i0 <br />South Main Street, Salt Lake City, Utah. The Motion requests <br />approval of a settlement of the above-captioned adversary <br />proceeding between the parties. CF6I brought this action against <br />Stollberg alleging that certain transfers made to it constitute <br />avoidable preferences under 11 U.S.C. § 547(b). The parties; have <br />agreed to settle the matter with Stollberg making a payment of <br />$6,000.00 and being permitted to file an unsecured claim in the <br />same amount or an amended unsecured claim including such an <br />amount. Copies of the Motion and the related Settlement <br />Agreement may be obtained by request from the undersigned counsel <br />for CF6I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 52?i(b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, and ~;erved <br />upon the undersigned counsel on or before Tuesday, September 21, <br />1993. Absent timely filing and service of objections, the <br />hearing may be stricken and the relief sought in the Motion may <br />be granted by the Court without further notice or hearing. <br />Additionally, upon the resolution of any timely filed and served <br />objections, the hearing may be stricken and the relief sougY.it in <br />2 <br />
