Long <br />Divigon Director <br />The following listed issues remain to resolve permit requirements related [o the slurry wall and mining <br />setbacks at the Cooley Reservoir and Fulton Wildlife Area. <br />1. The draft PSCo license item 17 indicates that slurry wall removal will be required upon CAMAS <br />abandonment of the site. This condition should be modified to state that the slurry wall is a permanent <br />facility. DMG is concerned with condition 17 [o [he license because the slurry wall is necessary to <br />achieve the proposed post mining land use. <br />2. It is not clear from the language in [he draft license that the mining setbacks proposed by CAMAS have <br />been accepted by PSCo in the compensation statement at item 23(e) of the draft license. 1 suggest that <br />the draft license be modified by adding the following sentence or a similar sentence to the end of item <br />23(a). "The licensee will maintain at all times the mining setbacks from the Public Service Company <br />right-of-way illustrated in exhibits A-1 and A-2 [o [he license." <br />The slurry wall costs of $3.00 per square foot are acceptable for [he purpose of determining the amount <br />of reclamation bond [o be required. Since the applicant has selected [he regulated construction option, a <br />condition of the permit must be [ha[ plans, specifications, and a quality assurance plan for the slurry wall <br />must be incorporated into the permit prior to construction of the slurry wall. The operator must also <br />provide a construction report at the conclusion of the installation and a certification that the slurry wall <br />was installed in accordance with [he approved plans and specifications. <br />If these issues are addressed, I would be prepared to recommend approval of [he application as it applies to <br />the issues 1 was assigned to review.
