• III III I II 1111111111 • <br />/y <br />May ,6, 1994 <br />To: John Nelson ~/~ //~/ <br />From: Jim McArdle '~"~ <br />Subject: GEC <br />Preston and I discussed the topsoil and seeding issues for about <br />1/2 hour today. I informed Preston that any debris (rocks) which <br />would interfere with drill seeding will have to be removed per the <br />general specifications as found on page 82. I outlined the items <br />discussed in blue. He indicated that he might look into buying the <br />additional seed for broadcasting and I told him to work it out with <br />you. <br />We had a general discussion of the topsoil pile at Chen's Hill and <br />on the west side of the east pit. I informed him that we would <br />take a close look at the bid document and the general <br />specifications and give him the benefit of doubt whenever possible. <br />Some of the possibilities discussed included the following. <br />1. He does not feel that either pile was included in the bid and <br />that as extra's we should pay the full cost. I told him that we <br />would review the amendment and the bid document. Also that we <br />would review the general conditions (noted in blue). <br />2. He refutes having lost 4839 cubic yards of topsoil. The two <br />acres of damaged reclaimed area at chen's hill (1613) and the <br />200'x200'x2' area at the south end of the East Pit. <br />3. I told him that if we determine that this was lost, I would <br />expect him to replace this soil at no cost to the division. At the <br />very least from the existing stockpiles. <br />4. I told him that I know for a fact that both topsoil stockpiles <br />were pointed out at the prebid and the preconstruction meeting on <br />the west side of the east pit and in fact the bid refers to <br />stockpiles. The written bid takes precedence over the drawings in <br />case of differences between contract documents. <br />Please review the attached general conditions carefully together <br />with the drawings and bid documents and draft a letter to Preston <br />for my review. I will be in Boulder with Julie and Maggie on the <br />6th and 7th and will try to call in during the day. Do not send <br />this letter out to Preston till I have a chance to review it. <br />Thanks for preparing me for Preston's phone call and thanks for a <br />job well done. <br />
