The application also <br />indteetes that the Cotter Corporation applied for and received <br />YflDES Permit PrC~-0001244 from the EPA on September 23, 1973, Bald' <br />permit tieing renewed with the Colorado Department of Nealth en <br />ilovember 15, 197$• <br />In view of the fact that the Cotter Corporation currently holds an <br />NPDES permit from the Colorado Department of Neatlh, "which ?wets <br />the requleements of the statute and the Mined land fieclematlon !'oard <br />pertaining to other permits {34-32-115(4) (c)) and rule 9.1 (2) of <br />the rules and regulations, I concur with your opinion that this is a <br />matter for the Water Quality Division of the Department of Health. The <br />Department could be sent a copy of the letter from Or. Johnson or <br />Dr. Johnson could 6e advised to contact said Division. <br />
