This is an extra map from the files, which you may keep. <br />The Division of Minerals and Geology seeks to eliminate dual enforcement and minimize dual <br />oversight at Colorado mine sites insofaz as possible. We appreciate the cooperation that EPA has <br />extended in this regard in the past at other mines. As the Butala operation may require some <br />shared oversight, it may be appropriate and expedient to define our individual roles, both for the <br />benefit of our agencies and the operator who is affected. <br />As we understand it, EPA will oversee disposal of materials at the Butala Pit that may contain <br />creosote or other hazardous waste. Such oversight may involve onsite reclamation, placement in <br />a hazardous waste landfill, or incorporation of the creosote materials in an asphalt batch plant. <br />Ordinarily, where batch plants aze installed at mine sites, the Colorado Mined Land Reclamation <br />Board holds a bond for the dismantling, removal, and reclamation of the plant site. In the present <br />situation, it may be feasible for the Board to handle the reclamation, or EPA may decide to <br />handle the matter themselves. Whatever the case, you should decide how EPA plans to proceed <br />and then please coordinate with DMG regarding the reclamation. <br />Unless we hear from you otherwise, the Division of Minerals and Geology will assume that EPA <br />will tend to all matters pertaining to the identification and disposal of contaminants at the Butala <br />site, and DMG will tend to matters pertaining to mining and reclamation, except as noted above. <br />If you determine that this is not a workable strategy, please let us know so we can meet to discuss <br />the issue. We assume further that by taking over the responsibility for the regulation of <br />contaminants at this active mine site, that none of the ordinary functions and duties of our mine <br />
