To protect and preserve breeding and nesting habitat for the Loggerhead shrike and other <br />Neo-tropical birds, disturbances in sagebrush, Gambel oak stands, and riparian areas will be <br />avoided to the extent practicable. (Unsuitability Criterion 14) <br />i6. If there is reason to believe that new individuals or populations of Threatened or <br />Endangered, or Sensitive (TES) species of plants or animals, or migratory bird species of high <br />Federal interest occur in the area, the lessee shall be required to conduct an intensive field <br />inventory of the area to be disturbed and/or impacted. The inventory shall be conducted by a <br />qualified specialist and a report of findirigs will be prepared. A plan will be prepared making <br />recommendations for the protection of these species or action necessary to mitigate the <br />disturbance. The cost of conducting the inventory, preparing reports and carrying out mitigating <br />measures shall be borne by the lessee. (Mitigations V-3, TW-1, TW-2). <br />The impacts to this alterative were addressed in Chapter 3 of the North Fork Coal EIS (2000). <br />The analysis in this EIS considered cumulative and off-site impacts. This decision may cause <br />off site impacts that are outside the jurisdictional authority of the BLM or Forest Service to <br />manage. The Final EIS discloses these impacts and lists potential mitigations, and further <br />shows the agency with appropriate jurisdiction. The following is included to show mitigations <br />that are recommended for other agencies to consider during their approval/permitting process <br />with regard to this project: <br />1. Provide additional air quality data for any future air quality permitting in the North Fork Valley <br />(Mitigation AQ-2). <br />BLM -Elk Creek Coal Lease Tract <br />
