~..
Mr. Weaver Page 2
November 14, 1995
release before any monies could be released to you. Following eeeding of the
site, a minimum 10-year liability period must pass before the site could be
released in its entirety. The Division would continue to conduct inspections and
you would be responsible for doing any maintenance that ie required and
conducting quarterly pond inspections and submitting discharge monitoring reports
as long as the pond ie on the site. To remove the sediment pond, a demonstration
proving that the reclamation ie adequate to control sediment would be required.
This demonstration could not be submitted sooner than two years following eeeding
of the Bite.
A third option you could select would involve transferring the permit and bond
liability to an entity interested in and capable of completing reclamation at the
site. This new permittee would be respone ib le for making the necessary
reclamation and bond release demonstrations through the 10-year liability period.
Please let me know if there are other options that you would like the Division
to explore with you. I would appreciate a phone call from you as soon ae you
decide how you would like to proceed. Please call if you have any questions.
Si~e~ely, ~ ~'"~ ^ i7 ~
Environmental Pr,6tecaion Specialist
cc: Hike Long
David Berry
Susan HcCannon
CEJ/0021106
