Lxhhead
E:ecwlve D~redor
Dear Mr. Mautz, Michael 8. Long
Division Dueclor
We have received your faxed letter dated August 22, 1997 which relates a problem with flow restriction in the
domestic water supply to your cabin. As you will recall, you and l discussed this problem on August 21,
1997 while 1 was on-site with you and others at your cabin property. At that time I anticipated receipt of your
letter and therefore included this issue within my inspection on that date. The attached copy of my inspection
report reflects this fact.
In response to your concerns, on August 25, 1997, 1 contacted Phil Schmidt of Mountain Coal Company
(MCC) and requested that they investigate the flow restriction problem at your cabin. They agreed to conduct
a survey of the cabin in order to detect any additional settling which may have occurred since the last survey,
and a reconnaissance of potential causes of the problem. 1 contacted you on the same date, and requested that
you grant them access to conduct their investigation. You agreed. You also indicated that you were planning
to begin excavation of the buried water line, commencing at the back of the cabin, in order to uncover the
problem. I requested that you allow a MCC representative to be present during the excavation. Thank you
for agreeing to this request as well. I followed up with Mr. Schmidt of MCC, indicating your willingness to
allow access to the property and have a MCC representative present during your excavation of the line.
On August 29, 1997 1 contacted Phil Schmidt to be updated on any activities which had taken place. He
indicated that they were scheduled to conduct their investigation during the week of September 1, 1997 and
that you and a IviCC representative had communicated about the timing of your excavation of the line, so as
to allow their observation.
At this time, we must await the completion of the investigations to be conducted by both you and MCC in
order to make any further determinations or take any regulatory actions concerning compliance. Please
communicate the results of your investigation to us as soon as completed, so that we can re-commence our
activities in response to your letter.
If you have any questions please feel free to call.
Sincerely,
~~~C\~
Susan McCannon
Coal Program Supervisor
cc: Phil Schmidt w/ 8-22-97 faxed letter from Mautz
Michael Boulay w/o attachment
David Berry w/o attachments
